Deposits and agency fees
For leases signed since 1 August 2024, the deposit is limited to 2 months' rent and agency fees are split equally between landlord and tenant. Here is what that means when you move in and when you move out.
The deposit (garantie locative)
- Maximum 2 months' rent. Leases signed before 1 August 2024 could ask for up to 3 months.
- A bank guarantee instead of cash. The landlord cannot refuse a bank guarantee in place of a cash deposit.
- An inventory is required. If there is a deposit, landlord and tenant must sign a written inventory of the home's condition (état des lieux) together, at the latest on move-in day.
Getting your deposit back
The deposit comes back in two steps:
- Half within 1 month of handing back the keys, if the home matches the move-in inventory and you owe nothing.
- The rest within 1 month of the landlord receiving the final charges statements, or of the building's yearly accounts being approved.
If the landlord is late, send a formal notice. From then on, the landlord owes a penalty of 10% of the monthly rent for each month started.
Agency fees
- Split 50/50. For leases signed since 1 August 2024, the fees of an agent or other intermediary are shared equally between landlord and tenant.
- No legal maximum. The law sets how the fee is shared, not how much it is. Ask for the amount before you commit.
Checklist when you move in
- The deposit is no more than 2 months' rent (without charges).
- You and the landlord have both signed the inventory.
- Your share of any agency fee is half the total.
- The lease states the deposit amount.
